DELHI POLICE TO COME UNDER CONTROL OF DELHI GOVERNMENT – POSSIBILITIES EXPLORED

The dream of having Delhi Police under the present constitutional structure of Govt. of NCT of Delhi is not possible at all. The NCT (National Capital Territory) of Delhi came in existence under the 69th Constitution Amendment Act, 1991. This Constitutional Amendment Act empowers the Legislative Assembly of Delhi to make laws for any of the matters given in the States List or Concurrent List of the Constitution of India in so far as such matter is applicable to Union Territories i.e. to say that Legislative Assembly cannot make any law to bring Delhi Police under its administrative control because police set up in Union Territories is under administrative control of Central Government. This is possible only when status of full statehood is conferred upon the Delhi Government by another Constitutional Amendment Act and such an Act can only be passed by the Parliament of India.

It is a matter well known to one and all that past governments particularly the Congress led government under Ms Shiela Dixit had also made such promise in her early election manifesto but could not get it done despite the fact that the government at the Centre was also Congress Government. The reasons are best known to people all across the country. Therefore the present Kejriwal government, having outside support of eight Congress MLAs, can in no condition and circumstance bring Delhi Police under his control. And if any demonstration is organized to lodge claim over Delhi Police, it would never be possible unless Parliament of India passes a Constitutional Amendment Act to this effect.

Then should we continue to accept police indifference to the citizens; refusal to registrar FIRs(already numerous such refusals are on record) when in laws threaten to burn their daughter in law! Police are only for VIPs. At least the HM could suspend the SHOs/ACP to set an example and which have a great deterrent for future(DP) SUBRATA GUHA more  
Dear All It is certainly encouraging to see the sentiments of Local Circle Members that Delhi Police should be under the administrative control of Delhi Govt. and that for this purpose create pressure on the Central Govt. to pass a law or issue an ordinance. Idea is welcome. The fact is that an administrative issue has become a political agenda and therefore it will not be a cake walk to get a law passed or issue an ordinance. Delhi being political capital of the nation and Parliament being constitutional law framing authority, the issue becomes complex and will require long term public battle to move Lok Sabha and Rajya Sabha to enact a law for full statehood to Delhi. So let us take one step forward to raise our demand through AAP to take this issue with Central Govt. more  
We need to pressurize the Central Govt to pass whatever act is to be passed to get this done. If successive Delhi Govts felt Delhi Police should be under the control of Delhi Govt and most people feel it so and with good reason, then why this delay or hesitation at all. Just Issue the Ordinance but who wants to loose a milch cow. more
