Corruption in Property Transfer - Issues Faced

In addition to suggestions mentioned by me earlier there is on more important suggestion as under :

Most of the time a person interested to purchase any property is not aware of status of property means 1. who is the real and legitimate owner of the property many times there are encroachments ( land ) or sale to multiple people etc 2. whether property is free from loans or any other encumbrances liens etc. 3. Whether the entire property is legal one without any litigation disputes etc. 4. proper easy identification demarcation of property ( land plot) on lay out plan of area approved by Government authorities. 5. whether construction of flat house any other unit is as per plan approved by Government authorities what are deviations if any. 6. whether all Taxes other legal dues of the property has been deposited with concerned authorities and proof is available. 7. whether all relevant documents which indicates all approvals , ownership and other relevant data information are available for the property

There are many such issues . In India the Government is trying to move to digital economy transactions and everything so the Govt authorities like RERA or some other agency should have a website where all relevant details of all properties existing in country to be uploaded with proper identification , the above mentioned details and anything else which you can think of to be compiled collated and uploaded on website. All relevant documents ( authenticated ) to be uploaded on website the details to be revised updated from time to time.

In case there are any deviations or some documents are not available traceable the same to be clearly mentioned in designated place.

The first step is to bring transparency in identifying legal status of any property. Your organisation can take up with the central state Government and also supreme court of India for bringing in transparency in property deals. The other steps will become very easy more

very true......in navi mumbai lot of corruption like builder and land owner each other are not ready to transfer plot on society name......who are purchased flat they are crush in between...navi mumbai having lot of property issue....every RERA not observing they have to look builder background and then approve with reg no. most of builder are related to criminal activity. more  
Whether RERA or before implementation of the same, investor is a victim in more than 99% . The agreemants are designed by the builders where all the provisions are in favour of the builders or colonisers, eg on delays in payments of due instalments in general, an interest @24% shall be lavied on investor for the default period but on the other side if possession of the property is not handed over to the investor within stipulated period by the builder, consumer forum allows only 9% to the investor. Question arises why the builder should give possession at the right time while he has a privileage to enjoy large amount received from investors in advance at 9% only instead of 18% or more from Banks and 36% from money market. Investors are at the mercy of the builders in the matter of getting possession of the property even after payments of maximum or full amount. On filing case under RERA builders get time of 2-3 years under state forum. Builders prefer that consumers should go to Forum so that they are facilitated to enjoy cheeper money deposited by consumers. In brief benifits and interests of builders are safe gaurded and protected by the Govt and its machinery to the highest level at the cost and perils of the investors and consumers. The consumers are left over unsafe and unprotected by builders and Govt machinery. more  
5.If possible photocopy of Regdd deed may be obtaqined bfore purchasing  and get it checked throughly.'6. If posible do direct purchase from the seller  without involvinmg un-registered dealers or tougts. 7.Before  puchasing fair Market Value of the propety may be inquird from rwegd valuer. Generally is observed that local development authorities are in connivance with the builder/promoters. Despite complaint they keep on shielding the builder/promoter. Obviously due to rampart corruption. This state shall continue till the authorities are not made responsible action is not taken against them. more
