Sirs, There are many like me who are made to sign a letter of allotment by the builder where in maximum points are favoring builder. Then as per wish the builder changes the layout, delivery date, flat area. On questing builder quotes from relevant para in the agreement that shows he can do it. Now buyers feels cheated and looks for remedy..... This is my story and i seek expert opinion for taking action against this builder for unethical demand and forcing us to sign one-sided builder buyer agreement.. Thanks and regards more

In general, you will have to abide by the initital contract but if the terms are partial and favour the builder against consumer rights, you can approach the consumer forum to declare the contract void/get a compensation, etc. You can ask an expert lawyer for free by posting your query on www.ruly.in more
Firstly, why cant the Govt give a format of an agreements for purchase of flats? Then, the builder cant add his own clauses.These are simple and easy ways to protect the purchaser, who is invariably a small person compared to the money and clout of a builder. The Authority must act quickly and render justice to the purchaser. Our laws are very weak, builders unscrupulous, Govt siding them and the courts are extinct long back. Dear Mr. Pawas Prasoon. As far as agreement with builder is concerned, all the terms and conditions giving undue favour to builders will stand null & void in Court of Law as well as Consumer Court. You, please take help of expert legal advisor who has experienc in fightling such cases in court of law. As a common man is unaware of such facts about law the builders take undue advantage of their ignorance. Once you file the case in consumer court and if you can afford, in civil court also, the builder will come begging at your door. In rencet weeks TOI, Mumbai edition has reported many cases where builders were heavily penalised for such acts. So go ahead and Godwilling you will get what is your right. Good Luck. more
