Apple denied warranty on pretext of accidental damage

Is there anyone else facing a similar issue? My gently used Apple iPhone 6 bought from Amazon India Pvt Ltd gave problem within six months of usage. Apple denied repair under warranty on the pretext of accidental damage.
I filed a complaint with consumer forum and their response is the same after 'investigation?'
Please suggest should I pursue this case or there is no hope?
Is Amazon responsible for selling a defective product? as my device is not accidentally damaged as claimed by the company. more

Over and above the Consumer Fora, you can also initiate Civil & Criminal Proceedings independently, subject to time, efforts and money. It is the usual phenomina of rsponses received. As the Product in question must have the warranty &/or gurantee so also you must have preserved the transaction & delivery details, which will play vital roll in all the proceedings. A good case to context to. more
No Amazon is not responsible for selling the defective product after 6 months of usage. Amazon can intervene and can initiate refund / replacement if the product is found defective within 7 -15 days of delivery of the product (As per the T&C's mentioned during placement of order. Defects found after that period are the responsibility of the Manufacturer in this case Apple. Please note that Apple is selling refurbished products in India (after obtaining requisite permission from Indian Government) in addition to the New Phones. Refurbished products carry lesser warranty period Generally most of the deep discounted phones are refurbished. On all e-commerce websites there are sellers who are selling both new and refurbished products. You have to be very careful while placing order for expensive products and do a careful research on the seller and the product you are buying. That said you need to visit Apple service center and report your complaints. If they say that phone has user damages, then find out what sort of damage they are referring to. Accidental damage can be due to various causes and unintentional. You have not mentioned the kind of damage / problems you are facing so it is difficult to provide any suggestion. more
Is it a new experience, I doubt, such complains are quite frequent on Consumer Circle forum, still none of your is ready to take a cautionary note. Apple will not take responsibility as it has not been purchased directly from them or an authorised retailer. it may be reconditioned one, how a company takes responsibility on such product? As you filed a case in Consumer court so, wait for verdict and persue with E-Commerce till they don't get a notice from consumer court. As per rule E-commerce retailer has to take responsibility and in future don't make the repeat mistake. more
Depends entirely on the reason they're saying "accidental" damage - if there are water stains on the inside (when its opened) or there's a dent / breakage on the screen / sides / back that's enough ground to nullify the warranty. Get it examined by another service center for "accidental" damage - if they also say that accidental damage is visible, don't waste your time. more
If the Consumer Forum has passed an order and you are sure that it is a company defect, you can appeal against the order in the State Consumer Forum . I think there is a time limit of 30 days from date of order. more
