Compensation for Negligence

This morning a friend was in Jet Airways flight with 166 passengers from Mumbai to Jaipur which had to turn back shortly after take-off this morning as over 30 passengers suffered ear and nose-bleed after the crew on flight 9W 697 reportedly forgot to select a switch that helps maintain cabin air pressure during take-off.

Can we please have Jet compensate 10 lakhs to each such passenger?

Such negligence is just not acceptable. Need standards in medical, aviation similar industry so no one dares to do it. more

Need involvement of Aviation ministry. There might be some inter-lockings for the flight to go go beyond certain height and/or alarming sounds for the pilot which might be disabled in the plane. This is not desirable. I have come across air India fornot allowing me to complain against them as they say breakage of lock or locking arrangement can not be taken up as complaint. I doubt the potter staff are carrying appropriate tools to carry out thefts while loading/unloadings. On two occasions In last 6 months they have not allowed any compensation for breakage on my luggage. They even did not reply my repeated complaints written in March 2018. more

Ministry of civil Aviation /DGCA should suomoto take against the airlines and make the airline to pay compenstion. A policy in this regard be also formulated giving powers to the regulator and making applications to any forum/court will be time consuming. more  
There should not be any need to file individual case to district forum. The Government of India should intervene in this matter. They should ask the company to compensate the affected passengers and put the erring officials to task. In fact this is not a small negligence. Its a matter of so many lives. more  
Thanks for the details that crew forgot to select the switch which is not available in TV news. Yes. Why not. As the negligence was really life threatening, the compensation of Rs. 10 lakhs for the air traveler is not much and quite reasonable and within the jurisdiction of a District Consumer but firstly the state of affairs in Lower Consumer Forums is satisfactory, secondly, filing of different claims in different consumer forums will lead to conflicting pleas and thirdly, even after being decided the appeals and revisions may go on for decades through the State Commission, National Commission and Supreme Court. Therefore, the prudent course would be for more than 10 consumers to to join and file Consumer Case for a claim exceeding Rs. 1 crore in the National Consumer Disputes Redressal Commission at New Delhi which is Chaired by a former Judge of the Supreme Court presently Hon'ble Mr. Justice R.K. Aggarwal and many members former judges oh the High Courts and appreciates finer aspects of facts and law and decides the matter faster and there is only one resort left for the unsuccessful party i.e. the Supreme Court. more
