Does this qualify as profiteering

HP office printer ink was ordered via amazon. Originally HP MRP was 1076 or lower (may - oct 2017) and gst was 28%

After GST rate was reduced from 28% to 18% in Nov 2017, the MRP was increased to 1176.

As a result a product that was selling for sub 900 when gst rate was 28% was selling for 1022 post gst rate was decreased in Nov 2017.

Kindly investigate and advise if our understanding is wrong or HP is profiteering here. more

Undoubtedly its a case of profiteering. But this is not an isolated case. On reduction in the GST rates on various products/items, the traders have simply adjusted the difference amount of tax by increasing the prices thereof. Though reduction in tax rates does not effect the margin of the traders/manufacturers as 100% of the amount of tax so recovered from the consumers is payable to the government, raising prices of the products creates doubt as to whether the entire amounts of tax being recovered are actually being passed on to the beneficiary (government) or a portion thereof is being retained by them! Surprisingly, the government has not yet initiated any effective steps to ensure the trustworthiness of the traders/manufacturers in this regard. more
Appears to be a case of profiteering you may lodge a formal complaint with Standing Committee on Anti-Profiteering, e-mail id sc.antiprofiteering@gov.in more
Clear case of profiteering by HO more
The Seller has his own right to alter the price. He needs only to pay tax on that. more

Dear Rahul This is a packaged item with MRP of Rs.1076. Whether it is pre GST or post GST ,the rule of such items sold through market channels is that "The cost to end user shall not exceed MRP". In this case the MRP is 1076 and the seller has charged you Rs.1022. This cannot be booked under the anti profiteering provisions. Moreover please not that it is NOT HP ,charged you but it is one of the link in Chnnel distribution. In such case also the anti profiteering clause is not applicable to HP. The end user customer is the final decision maker to buy HP product or its substitute and he takes a call depending on quality of product, delivery and price. The same PPP applies here also. more
