Filing of Compaints/applications against profiteering - Reg

In response to the complaints/references on profiteering received from:
Miss/Smt Garima Sharma w.r.to profiteering by Crompton, frangrance sellers, Sony, Morphy Richards, IFB, Eureka Forbes, Racold, Samsung, Symphony Coolers;
Shri Anil Mehta w.r.to profiteering by Loreal, Bajaj Electricals and Vijay Sales;
Miss/Smt Urmila Das w.r.to profiteering by Cloudtail;
Shri Sridhar Mohan w.r.to profiteering by Palmolive;
Shri Sudesh Rai w.r.to profiteering by Nestle;
Shri S K Virmani w.r.to profiteering by Industries;
Shri Kajal Singh w.r.to profiteering by Johnson-Johnson;
Miss/Smt Sandhya Agarwal w.r.to profiteering by Godrej;
Shri Rahul Sharma w.r.to profiteering by Amway;

With reference to your E-mails, it is advised that complaints against profiteering may be submitted in the form APAF-1 (copy attached) along with relevant invoices/bills issued before and after reduction in rate of tax/benefit of ITC; pictures of the products and/or the samples (if any), at the earliest so as to initiate fruitful investigation.

2. The form APAF-1 can be downloaded from the website of the Central Board of Indirect Taxes & Customs (CBIC) VIZ: http://www.cbic.gov.in/htdocs-cbec/gst/index and the duly filled application along with the supporting documents can be furnished. A dedication helpline No. 01121400643 is established to resolve the queries related to registration of complaints against profiteering and the same may be used for lodging the complaints.

3. Further, complaints against profiteering can also be lodged online on the website of National Anti-profiteering Authority (NAA) whose web address is “www.naa.gov.in”. The status of the application filed online can also be tracked in the NAA website.

4. It may be further noted that applications/complaints of profiteering by suppliers having pan India presence are to be filed with Standing Committee of Anti-profiteering under National Anti-profiteering Authority whereas applications/complaints of local nature (Hyderabad Zone) may be filed with the State Screening Committee. The details of the Screening Committees are available in the website of National Anti-profiteering Authority.

5. Complaints against profiteering by the suppliers located in Telangana State may be sent to the following address:
Telangana State Level Screening Committee on Anti-profiteering,
H.No. 11-4-649/B, Lakdi-ka-pul, Hyderabad-500 004.

6. It may please be noted that unless specific instances, along with the documentary evidence is brought on record by the interested person in filing the application under the form APAF-1, it is not feasible to initiate any action by this office.

7. However, the general information submitted based on the fact of reduction in the rate of tax is circulated among field formations, for information.

Sir. Is it necessary to have purchase invoice before the rate change and after rate change to lodge a complaint. Are screenshots from Amazon not enough? more

Glad to see a post from Commissioner in response to the issue of profiteering. more  
Helpful information. Complaints of the type can be handled by two types of actions. One is the legal way, filing a complaint, investigation, prosecution, hearing, passing judgement, enforcing the judgement etc which needs legal proof. The other action could be to open a separate web site, record the complaint, pass on the compliant to the manufacturer, seller who ever is the offending party, get his reply and post it at the web site; if the offending party refuses to reply that can also be posted at the web site. This action will be a positive way and may induce some to correct their wayward ways. more
