No Action by J&J For Hip Revision Surgeries

After the guidance/directives given to J&J by courts/government related to the Revision Surgeries for Hip Joint Replacement operations, there seems to be no action taken by J&J or it’s subsidiary company Depuy.

Around 2012, J&J India had taken up the drive for registering the details of the patients, who had undergone a hip joint replacement surgery, using the implants made by J&J-Depuy, which were then banned by the US FDA and J&J-Depuy were directed to give compensations to all the patients residing in the USA.

One MUST note that Reimbursement of Expenses is NOT a Compensation.

Compensation starts AFTER ALL EXPENSES ARE REIMBURSED.

The patients can be categorized in following categories :

Category A The patients, who were registered with J&J-Depuy after their first Hip Joint Replacement surgery wherein implants made by J&J-Depuy were used, the patients had undergone a Revision Surgery/Surgeries of the Hip Joint implants, the patients had claimed Reimbursement for the Expenses towards the Revision Surgeries done for replacing the implants, only a partial reimbursement was given to the patients but no Compensation was given to them.

Category B The patients, who were registered with J&J-Depuy after their first Hip Joint Replacement surgery wherein implants made by J&J-Depuy were used, the patients had undergone a Revision Surgery/Surgeries of the Hip Joint implants, the patients had claimed Reimbursement for the Expenses towards the Revision Surgeries done for replacing the implants, but neither any Reimbursement nor any Compensation was given to them.

Category C The patients, who were registered with J&J-Depuy after their first Hip Joint Replacement surgery wherein implants made by J&J-Depuy were used, the patients had undergone a Revision Surgery/Surgeries of the Hip Joint implants, the patients had NOT claimed any Reimbursement towards the expenses for the Revision Surgeries done for replacing the implants, hence neither any Reimbursement nor any Compensation was given to them.

Category D The patients, who were registered with J&J-Depuy after their first Hip Joint Replacement surgery wherein implants made by J&J-Depuy were used, the patients had NOT undergone a Revision Surgery/Surgeries of the Hip Joint implants, and hence had NOT claimed any Compensation.

Category E The patients, who were NOT registered with J&J-Depuy after their first Hip Joint Replacement surgery wherein implants made by J&J-Depuy were used, the patients had undergone a Revision Surgery/Surgeries of the Hip Joint implants, the patients had NOT claimed any Reimbursement towards the expenses for the Revision Surgeries done for replacing the implants, hence neither any Reimbursement nor any Compensation was given to them.

Category F The patients, who were NOT registered with J&J-Depuy after their first Hip Joint Replacement surgery wherein implants made by J&J-Depuy were used. However, the patients had NOT undergone a Revision Surgery/Surgeries of the Hip Joint implants and hence the patients had NOT claimed or given any Compensation.

It is evident that the actions for all the categories cannot be taken one after another, but have to be taken simultaneously. That is NOT happening.

In addition the Category ‘A’ mentioned above gets sub-divided into two categories.

Category A-1, where the patient, after the Revisi0n surgeries for the Hip Joint Replacement developed complications after the surgeries, and suffered multiple deceases which had not existed had the revision surgery was not required and hence was not done.

Category A-2, where no extra complications existed.

Now that the Compensation amount suggested is minimum of Rs Twenty Lakh Rupees, and shall depend on the extreme circumstances the patient was forced to go through as a result of these Revision surgeries, the patients covered under the categories A1, A2, B & C, who are registered with J&J-Depuy and whose all the details for the revision surgeries are readily available with J&J-Depuy, the company should have tried to contact them for getting the details of the additional damage, if any, done due to the Revision surgeries of the Hip Joints.

Unfortunately, there is no action whatsoever taken by the company, who apparently is only busy in giving priority to look for the details of the patients to get them registered.

That is only an action from the company, for taking no action towards Reimbursements and Compensation.

Can the concerned departments look into the matter to expedite the relief from the financial constraints the patients and their relatives have gone through due to such Revision surgeries? more

It was a great work done by the Health Ministry to have fixed minimum compensation of Rs 20 lakhs to the patients having undergone multiple revision surgeries for their Hip Joint Replacement using J&J Metal to Metal implants. Now, can the ministry fix a last date for J&J to get the work completed. Or at least the ministry can say, the first phase of this exercise, in which the names and all the details of the patients is available with J&J, who can first pay the compensation of Rs 20 lakhs to each of such patients and then start the exercise o going through case by case to arrive at the real compensation amount, so that the difference can be paid to a patient, once such an exercise is completed for that patient alone. Already patients have registered with J&J, and hence J&J can start the work in the serial order, where J&J already has information about the revision surgeries done for that patient, that waiting to get all the records straight. One must note, that as per the media debate held on Mirror Now TV channel on 7th Sept 2018, the compensation (other than reimbursement) given to the patients in USA for such revision surgeries was equivalent to Rs 2.22 Crores per patient. Rs 20 lakhs is less than one percent of that amount. Can the ministry please look into the matter and act favorably to the suffering patients? Till the individual patient’s case is studied if and when possible, the patient shall at least have Rs 20 lakhs in hand to have a mental relief from the financial stress and stain he/she and his/her family members have gone through. more

Patients with defective hip implants are already traumatized. They have limited mobility. The patient party themselves are also senior citizen. They will not be able to take the hassles demanded by J&J to give compensation. (As if they are giving honorarium). J&J must be comprehensively pulled by the court as well as the government. J&J must also be ordered to depute their personnel to the patients, get the papers filled and signed, and arrange quick payment to their bank accounts. Failing which, J&J must bear additional fines and interest for delayed payments. NGOs in each city must also come forward for ensuring that each patient has received full compensation quickly. more

SIR, RECENTLY THRU THE NEWSPAPERS J&J has advertised in this regard for your kind information. But yes may be because of customers like you J&J might have noticed this problem and taken corrective steps. more
