Online Portals need to be taken to Criminal Courts for cheating customers

Dear Readers and leagal experts, A case has been filed in the local magistrates court at Secunderabad against M/s.Shopclues.Com for offences punishable under section 420 for cheating.
I had placed an order for a 2in2 laptop as per what was displayed on the webportal of www.shopclues.com and was sent was a used piece with warranty expired and it was not as specified on the webportal.
Private complaint filed in 2017, A criminal Case registered as Calendar Case No.1245 of 2017, summons sent and received by the proposed accused. Does not appear before the Honorable Court on the specified date, and is also not represented by a Advocate. Honorable Court adjourned the matter for 2 years and finally issued NBW.

I wish to know what is the next step that needs to be taken by me in case of the Police being unable to produce the proposed accused before the Magistrate on the next date of hearing.

Please kindly advice. more

I thank this forum and Portal, and I think the CEO-Shopclues.com should also thank this platform, I thank for permitting me to post my difficulties and seek advice, and the CEO-Shopclues.com should thank because of this portal he may have got to know that there is a NBW pending execution against him. Sir, first of all please note that your case comes under jurisdiction of Consumer Court . Please make copies of all documents available with you in this regard. Check for Consumer Guidance Center in your city. Consult the consumer guidance center and follow their advice. You have lost precious time may be due to ill advice of your lawyer who did not bother to check the jurisdiction of your case. more  
Request court for early final hearing,it is for the Police to take further action more  
just like the way bounced cheques are treated as criminal offence and criminal action police and court is taken, the fraudulence by online portals should be immediately treated as criminal offence and Legal and police action taken at once. more  
Please consult your advocate, who is handling the case. more  
I do not know how much money the advocate would have extracted by now and I believe they are responsible for most cases of miscarriage of justice. If for two years the case has been dragging on then it is better to try arguing the case in person. Personally I believe the magistrate has a responsibility to get the NBW executed by the police though I know that they invariably tell the litigant to approach the police authorities. The police should be able to execute the NBW without much hassles if only they are honest in their profession. more
