PROFITEERING BY REAL ESTATE BUILDER AGAINST GST LAW
1. I bought an under construction flat prior implementation of GST . On installments prior 01 Jul 17, I paid service tax at 4.5%. Now on installments that I am paying after GST implementation builder is charging me 12% GST on installments.
2. Further, as per GoI notification as the cost of building materials have come down post GST implementation it was directed that the cost of property cannot be increased putting the load of GST fully on buyer.
Please guide. more

There is a confusion being created by the Builders for Reasons best known to them. Ideally - write to the Builder n keep on record your request. Inform them of the Rule and ask Price Reduction. If they say verbally - ask them to Given Written Reply. Verbally U can say that U will take this Reply with suitable Authorities, GST n Anti Profiteering. They should confirm what ever they wish to, to take up with the TAX Authorities I am also on the point where they have confirmed that they will give the benefits as is applicable with the last payment. I am expecting their written confirmation any time. Problem will arise for those who R about 50 % work done. Builder can not give Credit for Total Tax increase since his major purchase would have happened before. U have to depend on your agreement n demand any Tax increase is not to your account. GST is not clear on this point. I do not know what support GST will give to the end client or the Builder who has to pay more Tax. Good Luck to keep the fight on more

Charging of 12% is right but benefit of GST should be passed on. The same can be done by way of discount or reduction/adjustment with last instalment. more

look up info. shared repeatedly before; worth finding out has the levy of GST on 'realty' since been made law, to justify promoter demanding and buyer making any payment for any under construction project ?! more
