Service Charge and GST

If a restaurant doesnt use air conditioning at all from Nov - March, does its customers still have to pay gst of 18% and service charge.

What if restaurant removes the ac for this period and puts it back in summer months? more

The Govt. fixed the rates based on some criteria. Donot know whether restaurants are following or not. I do not think it be possible to make it seasonal but we are at liberty to chose which restaurant to go. I heard some of the restaurants are charging high rate by showing even a non working or single AC. Loopholes need to be plugged. more

There can be duel MRP, but so far as the AC is concerned, it can not be divided in two different category. more

GST has been fixed based on certain parameters but unfortunately there are some loopholes in case of resturants/ hotels. Despite repeated attempts to invite the concerned attention, it got failed. Govt. is yet to come out on service charges and GST especially in case of food supply establishments. Complains were lodged but no results yet. more  
Dear Madam, Single GST registration certificate/ Number is allocated to a vendor or retailer on certain terms and condition and the vendor has to charge and pay GST accordingly. If the restaurant has the facility of air-conditioning, it will attract 18% GST, irrespective whether food is served in AC or non-AC enclosure or whether AC is switched on or not because, it cannot always be monitored whether AC was on or off while serving food. I have an observation that, usually food cost was higher in AC enclosures of restaurants than non-AC enclosures during pre-GST regime. After GST, those restaurants have started giving discount on food bill when served in non-AC enclosures, keeping base price same for both. Therefore, one can opt giving discount during November to March if AC is not switched on as we save on energy bills. But, most restaurant will not do so because of profiteering. And, there is no difference in food prices in star Hotels, whether served in AC or open air restaurants. more  
Have they printed GST TIN on the slip and given the breakup of Rs. 12 as Parking charges Rs, 10 + GST @ 18% is Rs. 2. If not, please don't pay additional Rs. 2 being charged on account of GST. more  
At Railway Stations for Scooter/Car parking they are charging extra amounts towards GST, for ex: Earlier they used to charge Rs.10/- towards scoot parking, now they are charging Rs. 2/- extra towards GST. Are they registered their name? Is it correct? Or are they exploiting at every hook and corner penalizing the public in the name of GST? It is heart burning situation, not just for Rs.2/- but every body trader/businessman etc. are penalizing in the name of GST. Are that amount is reaching to the exchequer, if so, it is okay for the development of our country. Recently the Government is reduced Rs.2/- towards excise duty on petrol which costs Rs.26,000 crores loss to the Government. Thus Rs.2/- has its own impact on the general public as well as Government. more
