MRP Excluding GST at Ashoka Hotel's Cake Shop
Last week I went to Ashoka Hotel for a meeting and on my way back decided to buy some cake. I was stunned that in a Government run hotel, the Cake Shop showed all MRPs excluding GST. Even more shocking was the fact that they charged me GST of 28% while the GST for chocolates and cakes is now only 18% ( Bill attached). Can the Consumer Redressal Forum bring the shop to book, so other customers are not fleeced. more

@Neeru Sood, Mam it is true that the MRP rules are applicable in the pre-packaged commodity and the commodities which have got price tag of MRP inclusive of taxes. The items which are being sold out of the shelf and are packed in the packing box to make it carry-in package are sold with taxes extra. In case the Chocolates are being sold in a pre-packaged boxex, then ofcourse the packet has a price printed on the box as inclusive of taxes. Your second query is that the hotel is charging 28% tax instead of 18%, please seek clarification from the GST Council and you can make the complaint accordingly. But I do not find any reason for the retailer to charge more tax than the applicable rates. The bill must be giving the code of the item which can be checked in GST Tariff. more

Your grievance is based on ignorance of law. MRP provisions apply to pre packaged commodities and not cakes and pastries sold in such shops which are packed in your presence. more

even 28% gst is right because ashoka hotel is five star and has a tariif rate of more than 5000 rupees. more
