Corruption in police and lower judiciary

“Higher judiciary is flooded with bail applications due to reluctance at grassroots to grant bail. Judges at grassroots are reluctant to grant bail”

The Chief Justice of India made this statement yesterday.

What he needs to know is this “ a ton of influenced and frivolous FIRs are filed using the police and then lower court parties involved including the local court judges are bribed to not give bail. As a result the honest have no option but to go to sessions court or high court.

There is a need to use centralisation and technology to minimise discretion of lower court judge and unless it is a real criminal case (murder rape major theft with evidence), the default option in all civil matters must be bail and the judge must be required to go a significant extra mile of they believe bail must not be granted.

Not only this corruption harasses innocent, it increases work load at higher courts and this has to be addressed.

Corruption is a symbiotic process in which both donor and acceptor are benefited. Therefore, there is no justification to fix only acceptor as the offender, leaving the donor. The issue of corruption in society can be resolved only when the donor is punished equally as the acceptor. Until then, this menace can not be eradicated. Let me share an instance, a lady complained in the year 2015 to the police in a dowry harassment case and FIR u/s 498A registered the same day, that her father gave Rs.25 lakhs of dowry to her father-in-law secretly within four walls during her marriage in the year 2004. Her father-in-law lodged a complaint to the Income Tax dept. to check for the sources of income to her father to give Rs.25 lakhs. He also complained to the Police dept. to cross check and verify by proper investigation about the said dowry. However, there has been no action on the complainant's father, though his own daughter gave a written complaint, which of course it is a fake, and false allegation meant to harass her husband and father-in-law and family members. Even the information about the report of investigation to this effect, sought under R.T.I. Act of 2005 from the Police dept. has not been provided till this day. The Police dept. has also filed the case in the Court in 2016, for which the trial has not been commenced till this day. more  
In this case, the discretionary power should be withdrawn by the Govt or conditions explained in writing. more  
If an offense is committed with non-bailable offense, the question of bailing the person should not come for hearing, but if the offense is committed under bailable offense, the bail should be granted. However, if the bailed person jumps the bail, he should not be granted bail. The courts may take decisions accordingly. more  
Courts have discretionary powers to go even beyond law while selling bail orders. After all, crores exchange hands in high profile cases. Who wants to miss the golden opportunity ? Many criminals go underground or leave country through various channels after buying bail orders by offering any amount. more

Imagine my registered letter to CJI in 1980 is still did not get an acknowledgement, because our Intelligence is so powerful. In 1959 my father purchased a village land and constructed a house, which I inherited. Now that house is in depleted state and I do not have enough money to reconstruct it. State admin collecting Property tax, Electricity and water charges says, you can not sell it, as the whole village lands are refused for registration. But some people are collecting the lands at through away prices. more  
There should be some conditions on which bail can be given otherwise it will lead to corruption and normally as one know it is only the influencial people with money who do all these kind of activities more
