DRUGS, COSMETICS, AND DEVICES -PANEL SET UP TO DRAFT BILL:

This Panel set up to draft Bill on Drugs, Cosmetics and Devices, under the Drug Controller General of India (DCGI). The composition of the panel will be from Health Ministry, State Drug Control Depts. and IAS Officers. The deadline to submit the Draft Document is 30th November. A good 2 months and 2 weeks to discuss, iron out & come out with the document that will be beneficial to the general public and thereby to the nation.

# WHY DEVICES, THAT ARE ENGINEERING GOODS ALSO COME UNDER DRUG CONTROLLERS ?
WHEN FOODS HAVE FSSAI, WHY NOT DEVICES COME UNDER AN APPROPRIATELY QUALIFIED TEAM / PANEL ?

Besides the other official parameters, Hope the matters of commercial and consumer interest will also be included.

Like the oft heard complaints and requests in the Circle posts,

* reasonable profitability margin – From manufacturing cost to the MRP COST . As there have been many complaints about huge margins given for the different levels of distribution.

* Imported items generally not bearing Consumer Details like MRP, Dt. of Manufacture, Use Before / Best before , Local contact details,

THERE HAS BEEN ALREADY A FEELING EXPRESSED THAT, THE COMPOSITION OF THE COMMITTEE COULD HAVE INCLUDED IMPORTANT STAKE HOLDERS LIKE, MANUFACTURERS, SCIENTISTS, DOCTORS AND PATIENT GROUPS TO COME OUT WITH A HOLISTIC DOCUMENT; THIS WOULD PREVENT ANY FORESEEABLE FLAWS IN THE DRAFT DOCUMENT; THIS WOULD MEAN GOING BACK TO AMEND IT AND WASTING VALUABLE TIME IN BRINGING IN THE WORKABLE BILL. more

Care must be taken to ensure that no unjustifiable pro-manufacturer policy is nodded under influence of any kind of any member of the Panel. The maximum permissible margin of profit over and above all costs involve in manufacturing including taxes and transportation etc. should also be earmarked excepting the life saving drugs, on which maximum margin of profit must be specified in the Bill itself. more  
Would the Bill also increase opportunities for bribe takers? more  
Yes as Mr. Bargava has mentioned there should be strict vigil on Spurious and sub standard Drugs. We hav already seen reports of COVID19 vaccines. Wat more ? more

Since 1990s, when manufacturing, trading and export of spurious drugs was at its peak, efforts are being made to control and stop the nefarious activities. That was the period when spurious drugs were sold openly without any fear of action by Drug authorities resulting in huge loss in profit of all leading pharmaceutical companies. About 20 or so leading companies formed Indian Pharmaceutical Alliance in December 2000 and started a campaign against spurious drugs in number of states where Spurious Drug business had taken deep routes. The campaign was a big success to un-earth the spurious drugs rackets and installed a fear among racketeers. The success of campaign made the Govt. of that time (2003 or so) to form constituted an Expert Committee under the chairmanship of Dr. R.A. Mashelkar to examine all the aspects regarding the problem of spurious / substandard drugs in the country and suggest a roadmap for implementation of the recommended measures so that this problem could be solved in its entirety. However, the committee’s recommendations, including life imprisonment to drug racketeers, did not dither them. Spurious Drugs dealers became more cautious and experienced in dealing with Police and Drug Inspectors etc. Their all activities were carried out underground. The campaign lost its shine with lack of cooperation of Police and the Drug authorities. By 2019 campaign was given up and thereafter due Covid 19 spread activities of spurious drugs dealers were not much noticeable. However, with ease in spread of pandemic, the spurious drugs racketeers are trying to raise their ugly heads again. Just today news papers have reported about Spurious Cancer drugs racket. While the set up of panel to draft a bill on Drugs, Cosmetics and Devices is a welcome step, but from the facts mentioned above, I feel unless there is strong will, integrity and honesty in the Enforcement agencies the proposed bill may become an exercise in futile. . more

This will certainly help the common man quite a lot. Only after the Jan Aushadhi shops came into existence a few years ago, I realised that cheaper drugs are certainly as effective as the costlier ones. Since, my wife and I are both physicians, we were able to monitor both clinical and laboratory parameters frequently after taking the cheaper alternative drugs, we counsel others to try these and save money. I am sure, the measures mentioned here will further reduce the medical costs substantially. I whole heartedly appreciate and commend the suggestions by Sri Daniel about the composition of this committee. more
