Judges, Magistrates &!Public Servants beyond probe

This is terrible. So does this mean a police official on duty can shoot a citizen they dont like and media cant even report it...Will all states and center soon follow this ordinance??

The Vasundhara Raje government has passed an ordinance which seeks to protect both serving and former judges, magistrates and public servants in Rajasthan from being investigated for on-duty action without its prior sanction.

The Criminal Laws (Rajasthan Amendment) Ordinance, 2017, promulgated on 7 September, also seeks to bar the media from reporting on accusations till the sanction to proceed with the probe is obtained.

“No magistrate shall order an investigation nor will any investigation be conducted against a person, who is or was a judge or a magistrate or a public servant,” reads the ordinance which provides 180 days immunity to the officers.

If there is no decision on the sanction request post the stipulated time period, it will automatically mean that sanction has been granted.

The ordinance amends the Criminal Code of Procedure, 1973 and also seeks curb on publishing and printing or publicising in any case the name, address, photograph, family details of the public servants. Violating the clause would call for two years imprisonment. more

On facing criticism from all quarters against the proposed draconian law, the Rajasthan Government proposed to review and suitably amend the same. However, further development in the matter was not reported by any media, as I guess. Had the Governor given his assent to this law and was he competent for this without making a reference to the President of the nation and whether our Constitution permits any State Government to enact such laws? more  
Rather it should have been reverse. Courts should be set up to try defamation suits when some wrong reporting is done instead of curbing freedom. In a democracy, freedom to opinions is guaranteed under the Constitution. Similarly, freedom to sue is also guaranteed, but repercussions of wrong reporting affect the individual's credibility. A few cases against wrong reporting with a stiff penalty for perjury could possibly curb this menace. Freedom of the press means responsible reporting. We have lost the essence of this and we enjoy the credibility of an individual being mauled. We are enthralled by negative reporting. Let us be more responsible before making allegations. more

It should be a jerk to all those who were keeping very high hopes on BJP Government working to curb the corruption. Whether it is BJP or Congress, hoping for any corrupt free system in the country will be a hoping against hope. It is only the enforcement which can be be done by the citizen participation can bring down the evil of corruption and for that first we citizens have to dedicate not to succumb to the pressure of demands by the corrupt system. more
