State of Jails in India - Key Issues

With this post, we would like to discuss issues with the current state of Jails/Prisons in India.

In India, majority of the people remain in prison pending trial or conviction. Statistics from Human Rights Initiative reveal that over 65% of the prisoners are under-trials and they may continue to be held in overcrowded prisons for years. The occupancy in prisons exceeds by 41.4% over and above its sanctioned capacity. A huge majority of these under-trial prisoners are poor. They are denied bail for want of monetary security. And trials take years. Often, they have no lawyers, live in pathetic conditions, do not have access to adequate medical care, and are likely to be tortured or exploited in many ways.

With this post, you may share every issue that you are familiar with including prison oversight, management etc as well as systemic issues that exist.

We will review the root causes and solutions separately to put together a whitepaper that can be shared with the key stakeholders for actions.

Solution lies with time bound speedy judgement of trials, so responsibilities for this must be fixed for judges more  
In industry,schools and colleges when there is a backlog people work overtime to catch up and come up to date. In judiciary when there is so much backlog, courts must work to central and state govt. holidays schedule and clear the backlog. Judges only give lip sympathy in public forums and do not do anything themselves to work more. There should be a time limit for cases under different sections of CrPC so that there is finality in cases and not dragged on for years. Every influential person or association goes on appeal till SC. Does it mean that HC and other courts are not competent ?? Quality and speed of Justice needs to be improved at all levels. If Corruption is rampant in court premises - why not install CCTVs all around and punish the culprits. There must be some yard stick for legal fees. Free legal service to needy will go a long way in instilling confidence of the poor in the judicial system more  
Make person like Kiran Bedi head of all jails in India. Give her mandate to reform the jails. Let there be no political interference in her work. She should even have her say in police investigations to expedite it to complete court cases more
