UP draft school fee bill - all states must follow

Sharing localcircles post from Uttar Pradesh circle. I think not just UP, all states should have this bill. Members esp parents/grandparents from different states here should get their state government to implement something similar.

UP school fee regulation bill is out

Many of you participated in polls earlier this year on regulating school fees in private schools. We are pleased to share with you that finally UP Govt has released its draft school fee regulation bill and it includes many of the demands raised by parents via LocalCircles. It also does not cap the absolute fee charged by schools as demanded. The bill is attached and below are the key highlights. Kindly share your inputs on the same and esp if anything is missing.

Highlights of the bill

The Bill provides for annual fee fixation, for both old and new students. Revision of fee for old students to be done annually should be equivalent to percentage of average per capital increase percentage of monthly salary of teaching staff during the previous year. This amount should not exceed the latest yearly published consumer price index plus five percent.

For fresh admissions, schools will determine the fee in a manner that its total income should exceed the total expenditure including the amount collected as development fund from the students.

When the income exceeds the expenditure, schools will be forced to reduce the students' fee. All schools irrespective of any Board, whose annual fees is above Rs 20,000 will only be covered under the Bill.

The proposed Bill has also done away with compulsorily charging of fee by some schools for activities/facilities like transportation (school bus service), boarding, mess or dining, excursions, which are optional. Only those students who wish to use these facilities and activities will pay the fees.

In the name of development fee, schools can charge up to 15% of the total fee charged, including possible and optional fee component. The amount collected will be used for development of educational purposes including establishment of a new branch or a new school under the management of same eligible educational entity. The Bill discourages the practice of bulk deposit (collecting annual fees at once). Instead, it provides for fee to be payable either monthly, quarterly or bi-annually.

All schools will have to upload on their website general details like accreditation and affiliation, admission policy, details of fee and fund structure for previous year, current year and ensuing year, details of facilities including hostel, sports, co-curricular activities and extra-curricular activities, details of students to space ratio and student to teacher-ratio, qualification of teachers, calendar of major events being organised by the school for students, teacher and other staff throughout the academic year.

The draft bill has stringent provisions starting from Rs 1 lakh to Rs 5 lakh and subsequently de-recognition and cancelling the registration of schools for charging more fees than prescribed. more

The governments should also ensure that the standard of education is simultaneously improved keeping in pace with international standard. It should also be ensured that the educational institutions are not simply converted into money minting industry and the benefits of annual increased fees are duly passed on to the teaching staff to maintain the standard of teaching. more  
Education being a concurrent subject between the Central and State governments, it is the responsibility of the state governments to establish government schools all over the state and run them efficiently .State governments must pay attractive pay packet to teachers so that qualified teachers will join government schools. Governments must spend a higher percentage of their revenue for education. If this is done private schools will not dare to charge exorbitant fees. In fact it is the politicians who start private schools and this is one of the means of earning money on which no tax is paid. more  
Article 36 and 12 mandates both States AND, Union as a whole since there is no specification of States in the issues of Education under Articles 15 [4], 41, 45 and 46 . Lists under VII th Schedule are to be amended suitably . more

We are Not a Socialistic Country. Neither fully Capitalistic. Please Push State Govt. to Improve the State & Municipal Schools Funding. Get Teachers & all facilities, Inst ed off pushing Private schools by Law. Utilise School Funds properly, Not to have wasteful Expenses. make the the Best , then Private schools will fall in line. more  
Monthly fees deposits should be a parental right, rather than an option. General practice of quarterly payments are a massive burden on 90% parents, as I had discussed with many parents. They often shy from voicing their reservation in school, as they fear a backlash by school authorities and their peers. Schools say you will have to request for depositing monthly fees, in some way one step of humiliation for your financial status. more
